If an artificial intelligence is indistinguishable from a person, how would a person ever be able to turn it off?

If it is as smart as a person you may not be able to. There lies the danger, one that you can't shut off because unlike us it would not necessarily be limited to a body. However I do not think we are there yet.

Realizing that this is a hypothetical question, I'd say that if an A.I. is intelligent enough to be indistinguishable from a person, it might, with the exception of our language, idioms, slangs and colloquial expressions otherwise be intelligent enough to be able to avoid detection in the first place.
On the other hand, if that A.I. was housed inside an android / humanoid body would we be able to distinguish any subtle nuances, differences, mannerisms that might tip it off? Possibly.

Will the real android please stand up! (new game show).

I've also heard people ask: If aliens were to come to Earth would they be smarter than us? You think? Really?
(and as they speed away saying, "You're right Klorbic, there's no intelligent life down there!"

I believe that truly intelligent AI would earn its place among humans by providing critic opinions and attitudes to different situations. It would stand out by its intelligence and ability to solve problems. People would want to get good advices from such a machine. But, as it is not alive, it shouldn't have equal rights to humans. When deciding whom to destroy - an AI or a human - the answer should be an AI, unless it proves it turned to alive being, feeling everything that living beings feel, even pain sometimes. That situation would equalize AI rights to the rights of every other living being. Then it should have a right to a life without pain and everything else that living beings deserve.

One of the arguments against a robot being accepted as human in Bicentennial Man was that as a robot he was immortal - so he could not be legally defined as human. I won't say how he got around this problem unless I spoil it for some.

I understand your answers, they are logical. But there's a paradox here: when science will free humans from suffering and death, should we loose our rights?

EDIT:
@ivan.moony - I know you're not only saying that pain is what makes us deserve rights. You also said "being alive" and "feeling everything". But I cannot define "being alive", and IMO "feeling things" is just input and treatment of incoming data, isn't it?
@Freddy - Do you think AI's lifetime length should be defined in advance, like in Blade Runner? It feels unfair to me. But I have a feeling that to live in peace, robots should not be allowed to have a stronger body than humans.
@ 8pla.net - Should AI have civil rights as well? I think so. The right to vote, the right to represent people in a political democratic arena.

I just wanted to show how complicated these issues look to me... I'm not sure we're politically and culturally ready for this final leap.
